Welcome to Bull’s Eye Pest Control, Inc. These Terms and Conditions govern your use of our website and the pest control services we provide. By accessing this site, requesting a quote, or signing a service agreement with us, you agree to the terms set out below. Please read them carefully. If you do not agree with any part of these terms, please do not use our website or our services.

Bull’s Eye Pest Control has been a locally owned and independently operated company since 2002, founded by Carl Durst and Terry Gilling. We serve homes and businesses across north San Diego County and Riverside County. References to “we,” “us,” “our,” or “the Company” mean Bull’s Eye Pest Control, Inc. References to “you” or “your” mean the customer or website visitor.

Acceptance of Terms

By scheduling service, signing a service agreement, paying an invoice, or otherwise engaging Bull’s Eye Pest Control, you confirm that you are at least 18 years old, that you are the property owner or have authority from the property owner to authorize pest control services, and that you accept these Terms and Conditions along with the specific service agreement provided to you.

We may update these terms from time to time to reflect changes in our services, applicable law, or industry practices. Any updates will be posted on this page and will take effect on the date posted. Your continued use of our services after a change is published constitutes your acceptance of the revised terms.

Our Services

Bull’s Eye Pest Control provides residential and commercial pest control services throughout our service area. Our standard plans include bimonthly general pest and rodent control, quarterly general pest and rodent control, and a mosquito-focused plan. Bimonthly and quarterly plans cover more than forty common pests, including ants, spiders, and rodents. Attic rodent work, termite services, and certain specialty treatments may carry additional charges and are quoted separately.

Because we hold an agricultural license, we are also able to treat full lots and landscaped exterior areas where many other operators cannot. We do not provide wildlife trapping or removal of animals such as raccoons, skunks, opossums, or similar species. Our technicians follow all federal, state, and local laws governing pesticide application, including the regulations of the California Department of Pesticide Regulation and the Structural Pest Control Board.

All services are performed by licensed, trained technicians using EPA-registered products applied at label rates. Product selection, application methods, and safety precautions are determined by the technician based on the pests present, site conditions, and label requirements.

Service Agreements and Recurring Plans

Our recurring pest control plans require a one-year service agreement. Bimonthly and quarterly plans include six maintenance visits per year. Mosquito plans are seasonal and structured around insect activity. The full terms of your plan, including the visits included, the pests covered, and any exclusions, are set out in the service agreement we send you through FieldRoutes when you sign up.

Each maintenance visit is scheduled for a minimum of twenty minutes on site so our technicians can perform thorough work. We will normally contact you by phone or text approximately thirty minutes before arrival. You may choose interior treatment, exterior-only service, or a combination based on your preference. If you elect exterior-only service, our warranty and re-service rights still apply to the exterior areas treated.

You agree to provide reasonable access to your property at the scheduled time, to keep children and pets out of treatment zones until products have dried as instructed by the technician, and to disclose any known allergies, medical conditions, or product sensitivities before service begins. Missed appointments without reasonable notice may be billed at the regular service rate.

Pricing, Billing, and Payment

The standard initial service for our bimonthly (every two months), quarterly, and mosquito plans is $299. Customers who enroll in a recurring maintenance plan receive a $200 discount on the initial service, bringing the initial visit to $99. This new-customer discount is available whether you sign up online or by phone. Recurring maintenance pricing is provided in your individual quote and service agreement. Promotional pricing offered through specific advertising channels is not always reflected on the website and is limited to the audience of that promotion.

You may pay per service, on a monthly schedule, or annually. Customers who pay for a full year of service in advance receive a 5% prepayment discount. Monthly billing runs on the first of each month for the upcoming service period. We accept major credit cards and ACH bank account drafts. By providing payment information, you authorize Bull’s Eye Pest Control to charge the payment method on file for services rendered, recurring plan installments, and any approved additional work.

Invoices are due upon receipt unless otherwise stated in your service agreement. Past-due balances may be subject to a late fee and to suspension of service until the account is brought current, to the extent allowed by California law. You agree to keep your contact and billing information current and to notify us promptly of any changes.

Cancellation, Renewal, and Refunds

Recurring plans run for an initial term of one year from the date of your first maintenance visit. After the initial term, your plan continues on a month-to-month basis until you cancel. You may cancel after the initial term by contacting our office by phone or in writing. Early termination during the initial term may result in repayment of the new-customer discount and any other promotional credits applied to your account, as set out in your service agreement.

One-time services and specialty treatments are billed as a single charge and are not refundable once the service has been performed. Prepaid annual plans cancelled before the end of the term will be refunded for unused, unperformed visits, less any new-customer discount or promotional credit you received and less the standard rate for visits already completed.

If you believe a charge on your account is incorrect, contact us within thirty days of the invoice date so we can review the charge and resolve any error.

Service Area

Bull’s Eye Pest Control serves north San Diego County, including Mira Mesa and surrounding communities, and Riverside County excluding the Coachella Valley. Our coverage extends east to the Beaumont and Banning area and north along the Interstate 15 corridor through Hesperia, Victorville, and the high desert. We currently serve a small number of customers in Anaheim by special arrangement. Service is offered subject to scheduling availability and route capacity, and we reserve the right to decline or discontinue service in areas outside our regular routes.

Warranty and Free Re-Service

We stand behind our work. After any treatment, some pest activity may continue for several days as products take effect and as pests inside walls or hidden harborages move into treated areas. If you continue to see covered pest activity more than seven days after a service, contact us and we will return to re-treat the affected areas at no additional charge for the duration of your active maintenance plan. This re-service guarantee applies only to pests covered by your specific plan and only at the property listed on your service agreement.

Our re-service guarantee does not cover pests not included in your plan, structural conditions that prevent effective treatment, infestations originating from neighboring properties or from items brought into the home after service, or situations in which the customer has declined recommended interior service or follow-up work. Termite, wood-destroying organism, and wildlife services carry their own separate warranties when offered, which will be set out in writing at the time of service.

Customer Responsibilities and Limitation of Liability

You agree to follow the post-treatment instructions provided by your technician, including any recommended wait times before re-entering treated areas, which generally range from a few minutes up to thirty minutes depending on the product used and the weather. You agree to keep children, pets, and other occupants out of treated areas until products have dried, to remove or cover food, dishes, and pet bowls during interior service, and to address sanitation, moisture, and structural conditions that contribute to pest activity.

To the fullest extent permitted by California law, Bull’s Eye Pest Control is not liable for indirect, incidental, special, or consequential damages arising out of or related to our services or your use of this website, including loss of use, loss of profits, or damage to property not directly caused by our negligent acts or omissions. Our total liability for any claim arising out of a service we performed is limited to the amount you paid for the specific service that gave rise to the claim. Nothing in these terms limits any rights you have under California consumer protection laws or under the regulations of the Structural Pest Control Board.

We will make commercially reasonable efforts to deliver service on schedule, but we are not liable for delays or failures caused by events outside our reasonable control, including severe weather, fire, flood, earthquake, public health emergencies, governmental orders, supply chain disruptions, labor disputes, or other acts of God or force majeure events. If such an event prevents us from performing a scheduled visit, we will reschedule the visit as soon as conditions allow.

Our website is provided on an “as is” and “as available” basis. While we work to keep the information on our site accurate, we do not warrant that the website will be uninterrupted, error free, or free of viruses or other harmful components. Any reliance on website content is at your own risk.

SMS and Text Message Consent

By providing a mobile phone number to Bull’s Eye Pest Control, you consent to receive service-related text messages from us and our service-management platform, including appointment reminders, technician arrival notifications, scheduling updates, account notices, and customer surveys. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any text message from us, and you can reply HELP for assistance. Opting out of text messages may affect our ability to deliver timely arrival notifications and other service updates. We do not sell or share mobile phone numbers or text-message content with third parties for their own marketing purposes.

Pesticide Notice and Re-Entry

All products applied at your property are EPA-registered and applied at label rates by licensed technicians in accordance with California Department of Pesticide Regulation and Structural Pest Control Board requirements. Upon request, your technician will identify the specific products used at your service and provide product labels and Safety Data Sheets. You agree to observe any post-application re-entry intervals communicated by the technician, including keeping children, pets, and other occupants out of treated interior or exterior areas until products have dried or until the time period stated on the product label has passed. If anyone in your household has known sensitivities, allergies, asthma, or pregnancy considerations, please inform us before service so the technician can adjust product selection and application where possible.

Photo and Media

Our technicians may photograph or document conditions at your property during a service visit for purposes of pest identification, treatment recordkeeping, internal training, and quality control. Photographs and documentation are kept in your service record. We will not publish photos that identify your home, your face, or other personally identifying details in our marketing without your written permission. Anonymous or cropped images showing pests, products, equipment, or general work scenes may be used in our marketing and educational materials.

Intellectual Property

All content on this website, including text, graphics, photographs, illustrations, logos, the Bull’s Eye Pest Control name and bullseye mark, and the overall design and arrangement of the site, is owned by Bull’s Eye Pest Control, Inc. or used with permission. You may view, print, or save individual pages for your personal, non-commercial reference. Any other use, including reproduction, modification, distribution, public display, framing, or use of any Bull’s Eye trademarks, requires our prior written permission.

Indemnification

You agree to defend, indemnify, and hold harmless Bull’s Eye Pest Control, Inc., its owners, officers, employees, and authorized representatives from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your breach of these Terms or of your service agreement, (b) information you provided that was incomplete or inaccurate, including failure to disclose pets, allergies, occupants, structural conditions, or third parties present at the property, (c) your authorization for service at a property you do not own or do not have authority to permit treatment on, or (d) the acts or omissions of anyone you permit to access the property during or after service. This obligation does not apply to claims arising from our own negligence or willful misconduct.

Dispute Resolution and Arbitration

Informal resolution first. We want to resolve concerns quickly. Before starting any formal proceeding, you agree to contact us by phone or in writing and give us a reasonable opportunity (at least thirty days) to investigate and respond to the concern.

Binding individual arbitration. Except for claims that qualify for small claims court or for injunctive relief to protect intellectual property, any dispute, claim, or controversy between you and Bull’s Eye Pest Control arising out of or relating to these Terms, our services, our website, or our advertising will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules in effect at the time the arbitration is started. The arbitration will be conducted in Riverside County, California, or by telephone or video at the customer’s option for non-evidentiary hearings. The arbitrator’s award is final and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. You and Bull’s Eye Pest Control each agree that any dispute will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of class proceeding.

Right to opt out. You may opt out of this arbitration and class-action waiver section by sending written notice to Bull’s Eye Pest Control, Attn: Customer Service, 30882 Wealth St, Murrieta, CA 92563 within thirty days after you first agree to these Terms. Opting out does not affect any other part of these Terms or your service agreement.

If any portion of this section is found unenforceable, that portion will be severed and the remainder will continue in effect, except that if the class action waiver is found unenforceable as to a particular claim, that claim must be brought in court rather than in arbitration.

Nothing in this section limits rights you may have under California consumer protection laws or under the regulations of the Structural Pest Control Board, and nothing in this section prevents either party from reporting alleged misconduct to any governmental agency.

General Provisions

Entire agreement. These Terms, together with your individual service agreement and our Privacy Policy, make up the entire agreement between you and Bull’s Eye Pest Control regarding our services and supersede any prior understandings on the same subjects. If there is a conflict between these Terms and your signed service agreement, the service agreement controls for the specific services it covers.

Privacy Policy. Your use of our website and our services is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary or, if it cannot be modified, severed, and the remaining provisions will continue in full force.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer your rights or obligations under these Terms or your service agreement without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets, in which case the assignee will assume our obligations.

Notices. Notices to you may be delivered by email to the address on file, by text message to the mobile number on file, or by U.S. mail to the service address. Updates to these Terms. We may update these Terms from time to time. The current version is the version posted on this page with the most recent effective date. Continued use of our website or services after an update constitutes acceptance of the updated Terms.

Electronic communications and signatures. By using our website or our services, you consent to receive communications, agreements, notices, and records from us electronically. You agree that electronic signatures, including signatures captured on technician tablets, online forms, and email confirmations, have the same legal effect as handwritten signatures.

These terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
